APP, Mr. Rajesh Jana ... for the State

1. The supplementary affidavit filed on behalf of the petitioners reveals that the petitioner no.2 is juvenile and his name should immediately be retracted wherever it appears.

2. The learned counsel for the petitioners submits that he shall not be pressing the application as against the petitioner no.2. Insofar as the petitioner no.1, it is submitted, that the allegations are false and the petitioner is falsely implicated.

3. The learned APP, appearing on behalf of the State in opposing the prayer has referred to the statement of the injured police officer.

4. Considering the materials available in the case diary and the statement of the injured witness directly implicating the petitioner no.1 for the alleged offence and having regard to the fact that the injury appears to be on the vital part of the body, we are not inclined to grant anticipatory bail to the petitioner

no.1. The prayer for petitioner no.2 is not considered and the petitioner no.2 shall be at liberty to take appropriate steps in accordance with law.
