Gunjan Ray v. Arindam Ray

2024-03-22Hon'Ble Justice Prasenjit Biswas2 pages

22.03.2024 S.L.25 Ct. No.655 KB C.O. 2615 of 2015 Gunjan Ray -Versus- Arindam Ray Both parties are not represented.

In pursuance of the direction passed by this Court a report is submitted today before this Court by the Assistant Registrar which states that no mediation report has yet been received by the department and prays for passing necessary order in this respect.

It appears that the instant revisional application is filed under Article 227 of the Constitution of India challenging the impugned order dated 25.06.2015 passed in connection with Matrimonial Suit No. 177 of 2012 passed by the Learned Principal Judge, Family Court, Calcutta. During pendency of this revisional application, matter was sent before the Mediator to find out an amicable solution to the problem which cropped up in between the parties.

But no mediation report has yet been submitted before this Court and direction was given upon the Learned Member Secretary, High Court Mediation Centre to submit a report. It appears from the report submitted by the office

that no mediation report has yet been received by the department.

Anyway, I find that there is no justification to keep this revisional application alive in this list as it is pending since the year 2015.

As such CO 2615 of 2015 is hereby dismissed for default.

Interim order, if any, stands vacated.

There will be no order as to costs.
