And In the matter of : Sri Joy Kumar Ghosh and another .... petitioners Mr. Sanjib Bandyopadhyay, Mr. Nabhajit Prasad Basu, Mr. Mukul Mukherjee ....for the petitioners Mr. Sanjoy Bardhan, Ms. Snigdha Saha ... for the State 1.

The learned counsel for the petitioners has fairly submitted that all the sections are bailable but the petitioners are prevented from moving the bail application as the complainant is an Advocate practicing in Howrah court and he and his associates are preventing the petitioners from moving the said application before the learned Chief Judicial Magistrate, Howrah.

In this proceeding, we cannot pass any order. 3.

However, the petitioners shall be at liberty to take appropriate steps by filing an application before the District Judge, Howrah bringing such fact to the attention of the learned District Judge.

Accordingly, the application for anticipatory bail is disposed of.
