This is a contempt proceeding arising from an order dated June 13, 2024 passed by this Court.
The order annexure-'A'
at page-18 to the compliance report shows that this Court specifically directed the Registrar to hear out and come to a logical conclusion on the issue. Annexure 'C' at page-31 to the contempt application, a communication issued by the Additional Registrar of Co-operative Society shows that in terms of the said order dated June 13, 2024, the Deputy Registrar, Co-operative Society was directed to conduct the hearing. This, according to the petitioner is the act of contempt.
Mr. Ankit Sureka, learned counsel appearing for the alleged contemnor submits that the definition "Registrar" under the statute includes Additional Registrar and Deputy Registrar. Accordingly, the power was delegated to the Deputy Registrar.
However, learned counsel for the alleged contemnor, on instruction, submits that the Registrar, if he is so directed specifically shall definitely hear out the issue and come to its logical conclusion strictly in accordance with the direction made by this Court on June 13, 2024. In view of the above, the Registrar, Co-operative Society, West Bengal shall conclude the hearing strictly in terms of the directions made in order dated June 13, 2024. The time frame shall reckon from today. Except the time frame, the order dated June 13, 2024 stands as it is and without any modification. With the above finding, this Contempt proceeding WPCRC 149 of 2024 stands dropped and closed.
The Rule issued, stands discharged.
The application, WPCRC 149 of 2024 stands disposed of, without any order as to costs.
The exception to the compliance report filed today on behalf of the petitioner is taken on record.
