Learned counsel appearing on behalf of the petitioner submits that both the petitioner and the alleged victim are adults. The de facto complainant was a married lady. She was in a relationship with the present petitioner and started pressurising the petitioner to get married to her.
Learned counsel appearing on behalf of the de facto complainant submits that the petitioner entered into the relationship on promise to get married, but is not fulfilling such promise. Learned counsel appearing on behalf of the State vehemently opposes the prayer for anticipatory bail and relies on the statement of the victim recorded before the learned Magistrate.
The victim has alleged in her statement before the learned Magistrate that the petitioner had given a promise to marry her, but now was not keeping the promise. There was a consensual relationship between the two for three years. It was also alleged that the petitioner had blocked her.
Considering the nature of allegations and the materials available in the case diary including the statement of the victim, which showed that there was some kind of relationship between the two consenting adults for some time, I do not think that custodial interrogation of the petitioner is required and I am inclined to grant anticipatory bail to the petitioner.
Accordingly, the application for anticipatory bail of the petitioner is allowed.
However, in the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on further conditions that the petitioner shall not threaten or intimidate witnesses and shall co-operate with investigation. The petitioner shall meet the I.O. once a week till submission of report in final form. The application for anticipatory bail is, thus, disposed of. (Jay Sengupta, J.)
