When the matter is called on for hearing, an adjournment is sought on behalf of the respondent no. 5 on the ground that learned counsel having instruction to appear on behalf of the said respondent has not been given Vakalatnama as yet.

However, since the order sought in the present writ petition is innocuous, the writ petition is taken up for hearing, upon granting liberty to the learned Advocate for the respondent no. 5 to file his Vakalatnama by August 24, 2022.

The grievance of the petitioner is that the objection taken by the petitioner against revision of time-table of Vehicle No. WB 37E/1356 approved provisionally by the authorities has not been considered. Such objection is annexed at page 18 of the writ petition.

Upon hearing learned counsel for the parties, WPA No. 18706 of 2022 is disposed of by directing the respondent no. 3, that is, the Secretary, State Transport Authority, West Bengal, to consider and decide on the objection given by the writ petitioner on August 1, 2022 (Annexure- P/6 at page 18 of the writ petition) upon giving an opportunity of hearing to the concerned parties, including the petitioner and the private respondent no. 5, in accordance with law, as expeditiously as possible, preferably within six weeks from date.

The learned Advocate for the respondent no. 5 is granted leave to file Vakalatnama for the said respondent by August 24, 2022, as indicated above.

It is made clear that issuance of provisional time-table in the interregnum, if so issued, shall not be affected in any manner by the observations made in the present order.

However, if such provisional time-table is issued, the same will be subject to the outcome of the consideration of the objection as directed in the present writ petition.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
