The writ application has been preferred challenging the orders dated 28.07.2023 passed under Section 14B and 7Q of the EPF Act.

It is stated that on 30.04.2025, a notice to show-cause was issued by the Recovery Officer as to why the warrant of arrest would not be issued. 3.
It appears that though two separate orders have been passed, both are dated 28.07.2023.

The notice of the Recovery Officer shows that the said order has been treated as a composite order. As such, the said orders being a composite order is appealable before the Central Government Industrial Tribunal.

Admittedly, the petitioner has not preferred an appeal.

Accordingly, the writ application is disposed of with liberty granted to the writ petitioner to prefer an appeal against the said orders before the Central Government Industrial Tribunal, within 30 days from the date of this order. The period of limitation is extended for the said period in the interest of justice. 7.
Pending hearing of the appeal, the orders under Section 14B and 7Q being a composite order along with the show cause notice be stayed till disposal of the appeal.

The respondents herein are also restrained from taking any coercive action against the writ petitioner till disposal of the appeal, if filed. 9.
It is made clear that in case no appeal is preferred as directed, the order of stay and the order granting protection to the petitioner shall stand vacated automatically on expiry of the period mentioned in this order.

It is further stated that this Court has not gone into the merits of this case and the appeal shall be considered by the tribunal in accordance with law. 11.
Writ application stands disposed of.

There will be no order as to costs.

Connected application, if any, stands disposed of.
14.
Interim order, if any, stands vacated.
15.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties, upon compliance with all requisite formalities.
