2) By presenting this writ petition, petitioner has prayed for continuation of his service as Valve Operator in Kalindi Water Supply Scheme under Public Health Engineering Department, Purba Medinipur. Prayer is made for setting aside engagement of respondent no. 11 as Valve Operator.

3) Mr De, learned advocate representing State respondents has opposed this writ petition on the ground that petitioner has never been formally appointed as Valve Operator by the concerned authority of Public Health Engineering Department rather work order was given to private entity and petitioner was engaged by the contractor.

4) On query being posed to learned advocate representing the petitioner relating to appointment/ engagement of the petitioner, satisfactory reply is not obtained. In the writ petition appointment/ engagement letter of the petitioner is also not annexed.

5) Taking note of the submissions made on behalf of respective parties and considering the materials available on record, it appears that no enforceable right is accrued in favour of the petitioner requiring issuance of mandamus in order to protect the right of the petitioner to continue his service as Valve Operator.

6) Hence, no relief can be granted to the petitioner.

7) Writ petition stands dismissed.

8) There shall be no order as to costs.

9) Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
