Mr. Rajarshi Basu Ms. Monalisa Das ... for the petitioner Mr. Suman Dey ... for the State This is an application under Article 226 of the Constitution of India wherein the writ petitioner is aggrieved by the inaction on the part of the respondent authorities in considering his prayer for higher scale of pay upon obtaining higher qualification.

After hearing the parties, I direct the respondent no.5 being the District Inspector of Schools (S.E.), Paschim Medinipur, to pass a reasoned order after granting an opportunity of hearing to the petitioner within a period of five weeks from date keeping in mind that the petitioner is presently posted in the district of Purba Medinipur but the right accrued to the petitioner when he was posted in the district of Paschim Medinipur. The reasoned order is to be given to the petitioner two weeks thereafter.

With the above direction, this writ petition is disposed of.

Since no affidavit-in-opposition is called for, allegations made in the writ petition are deemed not to have been admitted.
