The petitioner seeks release of arrears in terms of an approved order of the Civil Judge (Junior Division), 2nd Court at Burdwan towards the arrears of his pay from 1st April, 2003 till 31st October, 2006.

The petitioner retired as a Sheristadar of the said court on 31st October, 2006.

After application of ROPA Rules 2009, a revised PPO has been issued to the petitioner on 11.12.2015. It is not understood as to why the aforesaid arrears have not been released to the petitioner till date.

The Principal Accountant General (A&E), West Bengal was directed to file a report in this regard by the Court's order dated 22.11.2023, which has not been filed till today. There is no representation on his behalf.

It is now well settled law that any delay in payment of pension or arrears thereof causes immense loss and hardship

to a pensioner. In the instant case, the petitioner is above 70 years old. Delayed payment of pension invariably, therefore, has to carry interest.

In view of the order dated 6th September, 2016 passed by the Civil Judge (Junior Division), Second Court, Burdwan, this Court directs the Treasury Officer (1), Burdwan to release the said arrear of Rs.61,094.00/- together with interest at the rate of 8 per cent per annum on and from 6th September, 2016 till the actual date of payment within a period of seven days from the date of receipt of a copy of this order. 7.

The directions on the Treasury Officer(1), Burdwan are peremptory. It is expected that the Treasury Officer(1), Burdwan would comply with this Court's order without demur or questions and strictly in accordance with law. 8.

The writ petition is disposed of.

There will be no order as to costs.
