This is an application under section 482 of the Code of Criminal Procedure, 1973 filed by the petitioner for quashing of proceeding being G.R. Case No. 2740 of 2011 pending before the learned Chief Metropolitan Magistrate, Calcutta arising out of Hare Street Police Station Case No. 537 of 2011 dated August 3, 2011 under section 406 of the Indian Penal Code.

The matter appeared before the coordinate Bench on August 18, 2015, when the direction was given to the petitioner to serve the copy of the petition upon the opposite party no. 1 through the learned Public Prosecutor, High Court, Calcutta and upon the opposite party no. 2 by registered post with acknowledgement due and affidavit of service be filed on the next date of hearing.

It was further observed by the Hon'ble Court that the ingredients of the offence of the criminal breach of trust is not disclosed and in the co-lateral proceeding before the Debt Recovery Tribunal, Bank has admitted that major part of the loan advanced has been liquidated. In view of the long pendency of the matter and that the matter is running in the warning list since February 21, 2025, this Court is of the

view that there is no reason to keep the matter pending in the list. Accordingly, C.R.R. 2389 of 2015 is dismissed for default. Let a copy of this order be sent down to the learned Trial Court by the department forthwith for information and necessary action. (Chaitali Chatterjee (Das), J.)
