The order proposed to be passed in the present application under Article 227 of the Constitution of India would not cause any prejudice to the opposite party, as such, service of notice of the present application upon the said opposite party is dispensed with.

The petitioner is the plaintiff of Title Suit No. 74 of 2020, a suit for eviction of licensee, pending before the Court of the learned Civil Judge, (Senior Division) at Sealdah, District - 24 Parganas (South). In such suit the defendant/opposite party herein has filed the applications under Section 7(1) and under Section 7(2) of the West Bengal Premises Tenancy Act, 1997 way back on September 30, 2020.

The petitioner is complaining delay in disposal of said applications.

In view of the nature of the suit, the said applications prima facie appear to be not maintainable.

The learned Trial Judge is requested to decide the said issue as expeditiously as possible in accordance with law, and in doing so, shall not grant any unnecessary adjournment to either of the parties. C.O. 2695 of 2024 is disposed of with the above terms without any order as to costs.
