1. The petitioners pray for execution of the order dated 15th February, 2024 passed by the District Magistrate, South 24 Parganas under Section 14 (1A) of the SARFAESI Act.

2. The petitioners/ Bank deposited the cost for police assistance way back in May 2024 but till date no steps have been taken for handing over physical possession of the auctioned property to the successful bidder.

3. As the District Magistrate passed order under the provisions of the SARFAESI Act for handing over physical possession of the property, the said authority ought to ensure that the order is implemented. Enough time has elapsed after the petitioners deposited the cost for providing police assistance for taking over physical possession of the auctioned property.

4. The instant writ petition is, accordingly, disposed of by directing the District Magistrate, South 24 Parganas to ensure execution of the order dated 15th February,

2024 at the earliest without any further delay.

5. The District Magistrate shall ensure that the order is implemented latest within a period of four months from the date of communication of this order.

6. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
