C.R.M. (M) 1341 of 2025 In Re : An Application under Section 439 of the Code of Criminal Procedure/under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Pandua Police Station Case No.
of dated 13.02.2025 under Sections 140(1)/103(1)/238/61(2) of the Bharatiya Nyaya Sanhita. And In Re : Abhi Ghosh Mr. Joydeep Biswas Mr. Asok Das Mr. Kaushik Ghosh Mr. Shreyash Mondal ... For the Petitioner.
Ms. Amita Gaur Mr. Sujoy Sarkar ... For the State The petitioner is in custody for more than 7 months and prays for bail.
Learned counsel for the State opposes the prayer. It appears that wearing apparel of the victim and the blood stained jacket of the petitioner have been sent for forensic examination. Report is yet to be received. Though the post mortem report suggests that the victim died due to effect of intra cranial haemorrhage caused by ante mortem injuries and also that death may have been caused by hitting of moving object, the report also says that the cause can be confirmed by circumstantial evidence. Other injuries have been found in the body of the victim. The petitioner was last seen together with the victim prior to the alleged incident.
Considering the material on record and prima facie role of the petitioner derived therefrom, prayer for bail is rejected at this stage.
The application for bail is disposed of.
Case diary be returned.
Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
