The petitioner prays for shifting of water tap installed by the Kolkata Municipal Corporation in front of the house of the petitioner. Representation seeking relocation of the tap is pending consideration for a long period of time. It has been submitted by the petitioner that because of the tap, there is assembly of lot of people in front of the house of the petitioner which is causing nuisance.

It appears from the documents annexed to the writ petition that the petitioner is yet to file any representation before the Water Supply Department seeking shifting of the water tap. In the absence of a proper representation, it will not be possible for the Water Supply Department to process the prayer of the petitioner.

In view of the above, the instant writ petition is disposed of by granting leave to the petitioner to make proper application before the Water Supply Department.

In the event such an application is made, the same shall be considered after causing a spot inspection and after hearing the necessary parties.

The writ petition stands disposed of.

The instruction given by the Ekbalpore Police Station be retained with the records.

Urgent certified copy of this order, if applied for, be supplied to the parties expeditiously, on compliance of usual legal formalities.
