Versus

Ava Sarkar The matter initially appeared in the warning list on 29th November, 2022 and thereafter transferred to the regular list on 5th December, 2022. There was a clear indication in the list that the matter shall be transferred to the daily cause list on 5th December, 2022 and since then the appeal is appearing in the list. None appears on behalf of the appellants. The matter was adjourned on several occasions in order to enable the appellants to remove the defects. The appellants have due notice of the appeal since November, 2022.

In fact, we had granted time to the appellants to remove the defects as noticed by the Stamp Reporter in its report dated 02-122009. The appellants have virtually abandoned the appeal. In terms of our earlier order dated 14th December, 2022, the appeal stands dismissed for non-removal of the defects. The application is also dismissed.
