The order proposed to be passed in the present application under Article 227 of the Constitution of India would not cause any prejudice to the opposite party, as such, service of notice of the present application upon the said opposite party is dispensed with. The petitioner is the plaintiff of a connected suit for eviction, the said suit being Ejectment Suit No. 76 of 2018 is pending before the 2nd Court of learned Civil Judge (Junior Division) at Barrackpore, District - 24 Parganas (North).

The petitioner is complaining delay in disposal of the applications under Sections 7(1) and 7(2) of the West Bengal Premises Tenancy Act, 1997 and is praying direction for expeditious disposal of the said applications. It is disturbing to note that the applications under Sections 7(1) and 7(2) of the West Bengal Premises Tenancy Act, 1997 though were filed by the defendant way back on July 05, 2018, but the said applications are still pending till date. The provision of Section 7(2) of the said Act of 1997 mandates disposal of the application within a period not exceeding one year from the date of receipt of it, the learned Trial Judge therefore is requested to dispose of the said two applications as expeditiously as possible in accordance with law, and in doing so, shall not

entertain the prayer of the parties for any unnecessary adjournment.

C.O. 2699 of 2024 is disposed of with the above terms without any order as to costs.
