The petitioner participated in the 1st State Level Selection Test 2016 for recruitment of Assistant Teachers in upper primary level of Schools but was not selected.

The grievance of the petitioner is that he has scored more than 60% marks in the Madhyamik examination but the authority while assessing his academic score has awarded him 8 instead of 10 marks in respect of the said examination.

The petitioner is praying that the Commission be directed to recommend his name for the appointment after conducting personally test. Learned advocate for the petitioner submits that the petitioner in his online application mistakenly mentioned that he has scored below 50%

marks in Madhyamik examination though he scored more than 60% marks in the said examination.

The error in assessment of the academic score of the petitioner occurred due to erroneous information supplied by the petitioner in his online application, for which the authorities cannot be faulted. Besides the petitioner admittedly does not possess the required training qualification consequently is not entitled to be considered for the post he is aspiring.

The petitioner had participated in the selection process of 2016, therefore, must be knowing that for appointment in the said post the candidate must have a training qualification which he does not possess as such the prayer of the petitioner is highly speculative and mala fide. With the above observation the writ petition being W.P.A 18764 of 2022 is, therefore, dismissed without any order as to costs.
