On the file being sent by the department, this matter was placed in the list. It is running in the list for several weeks and has been called on from time to time.

No one has ever responded when the matter has been called on. The matter, therefor, was placed in the list with the note "First Chance". No one responded even at this stage. Then the matter appeared in the list marked as "Last Chance". Despite being called on several times when the matter appeared in the list marked as "Last Chance", no one appeared.

It appears that the General Secretary of a labour union which is, however, not a recognised union while representing casual workers in Indian Railway, Eastern Railway Division had filed this writ petition in the year 2007.

It further appears that with the passage of time the writ petition has become infructuous and as

such, the petitioner is not interested to prosecute the matter.

The application is accordingly disposed of without any order.

Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance of all necessary formalities.
