02.8.2024 Ct. No. 6 SL No. 40 SB C.R.M. (DB) 2450 of 2024 In Re: - An application for bail under Section 439 of the Code of Criminal Procedure in connection with Hare Street P.S. Case No. 70 of 2023 dated 10.3.2023 under Sections 120B /420 /465 /467 /468/ 471 / 474/475 / 477A of Indian Penal Code.

1. Petitioner is in custody for 408 days. He contends co-accused have been enlarged on bail. During hearing of application for cancellation of bail, Enforcement Directorate stated custodial interrogation is not necessary. Accordingly, he prays for bail.

2. Learned lawyers for the State submit petitioner in collusion with others had siphoned away large volumes of money through Jammu and Kashmir Bank to foreign shores.

3. We have considered the materials on record. Petitioner and others had entered into conspiracy and illegally transferred funds through the bank to foreign countries. Suo moto cancellation proceeding was initiated being C.R.R. 386 of 2024. In the said proceeding Enforcement Directorate submitted though investigation is in progress, custodial interrogation of the accused are not necessary.

4. Under such circumstances, we are of the opinion petitioner may be released on bail subject to the strict condition that petitioner prior to his release shall submit his passport before the learned Magistrate Signed By :

and report to the investigating officer once in a week until further order.

5. Petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- with two registered sureties to the satisfaction of the learned 17th Judicial Magistrate, Calcutta subject to the condition that the petitioner shall appear before the trial court on each and every date of hearing until further orders and shall not intimidate witnesses and/or tamper with evidence in any manner whatsoever.

6. In the event petitioner fails to appear before the Trial Court without any justifiable cause, the Trial Court shall be at liberty to cancel his bail without any further reference to this Court.
