The petitioner is a retired employee of Calcutta State Transport Corporation (in short, "CSTC"). The petitioner superannuated from service on August 31, 2022. The petitioner was paid 40% of the Provident Fund dues aggregating Rs.13,16,000/- on September 21, 2022, within one month from the date of his retirement.

Remaining 60% of the Provident Fund dues aggregating Rs.19,74,938/- has been disbursed to the petitioner on August 3, 2023, during the pendency of the present writ petition.

Ms. Dey (Basu), learned counsel appearing on behalf of the petitioner prays for interest on the delayed payment of Provident Fund dues.

Mr. Sen, learned Additional Government Pleader, appears on behalf of CSTC.

Considering the rival submissions of the parties and the materials placed on record, this Court is of the view that justice will be subserved by directing the CSTC/respondent no.6 to disburse interest at the rate of 6% per annum from September 01, 2022 (the date subsequent to the date of retirement) till August 3, 2023 (the date of actual disbursal). Such interest amount shall be paid within three months from the date of this order. With the directions aforesaid, WPA 18413 of 2023 is disposed of.
