On hearing the learned advocates representing parties, it appears that petitioner has prayed for transfer. It is pointed out on behalf of learned advocate representing West Bengal Central School Service Commission that petitioner was appointed based on selection process, namely, 1st State Level Selection Test, 2016 (Classes XI & XII). It is also submitted on behalf of the parties that the 1st State Level Selection Test, 2016 (Classes IX, X, XI & XII) has been set aside by the Hon'ble Division Bench and the issue is pending before the Hon'ble Supreme Court.

In view of pendency of the issue before the Hon'ble Supreme Court, at present no order need be passed. Hence, writ petition stands dismissed.

However, it is made clear that this order shall not preclude the petitioner to take steps in accordance with law in future if situation so arises.

There shall be no order as to costs.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
