(DB) No. 2822 of 2022 sl. no.37 In Re : An application for bail under section 439 of the Code of Criminal Procedure in connection with Deganga P.S Case No. 162 of 2022 dated 08.03.2022 under Sections 448/326/307 of the Indian Penal Code 1860 and adding Section 302/364 of the Indian Penal Code. Rejected And In Re : Subho Parui ..... petitioner Mr. Rana Mukhopadhayay ...... for the petitioner Mr. Swapan Banerjee Ms. Purnima Ghosh ...... for the State It is submitted on behalf of the petitioner that he is in custody for 171 days. He has been falsely implicated in the instant case. Principal accused is one Haran Parui who had murdered the son of the de-facto complainant over monetary issues. Learned lawyer for the State opposes the prayer for bail. He submits that petitioner in collusion with Haran committed the murder.
We have considered the materials on record. Incriminating articles including dead body were recovered on the leading statement of the petitioner. There are ample materials connecting the petitioner with the crime.
Under such circumstances and in view of the gravity of the offence, we are not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner is rejected at this stage.
