The prayer of the petitioner is for release of the money accumulated in a Fixed Deposit Account issued by United Bank of India which subsequently merged with the respondent Bank (Punjab National Bank).

Learned counsel appearing for the petitioner submits that the petitioner's mother passed away on 31.08.2010 and that the petitioner made several representations to the Bank for release of the money accumulated in the Fixed Deposit Account. The petitioner is the joint holder of the said account with his late mother (Renubala Talukdar).

Learned counsel appearing for the Bank submits that the petitioner has approached at a

belated stage and the records of the petitioner's case are not traceable.

Upon hearing learned counsel, the petitioner cannot be made to bear the consequences of the Bank losing the documents pursuant to the amalgamation in 2020.

WPA 18780 of 2022 is disposed of with a direction on the respondent Bank to consider and dispose of the representation dated 03.02.2022 within a period of four weeks from today by way of a reasoned order after hearing the petitioner. A copy of the reasoned order shall be made available to the petitioner within a week from the date on which such reasoned order is passed.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertakings.
