I have considered the submissions of the learned advocate appearing for the petitioner which includes amongst others allegations regarding preparation of title deed of a property which is alleged to be forged and fakely prepared. To that effect representations were made before the police authorities. However, the report of the police authorities are to the effect that there are disputes amongst the relations. After considering the report so submitted as also the contentions of the petitioner I direct that the petitioner would be at liberty to approach the jurisdictional criminal court by way of

invoking the provisions under section 175(3) of the BNSS. The jurisdictional court would independently assess whether any cognizable offence is made out and therefore exercise its discretion in accordance with law.

With the aforesaid observations WPA 19237 of 2024 is disposed of. Pending applications if any are disposed of.
