The petitioner had participated in the NEET (UG) 2025, his All India Rank under the OBC-NCL category is 55730. He has applied for counseling under the West Bengal State quota but at the time of logging in for verification/registration, has mistakenly selected the NRI quota.
The petitioner thereafter had applied to the Director of Medical Education, West Bengal, the respondent no.2 herein, for correction of such mistake to which the respondent no. 2 has replied vide Memo bearing No. HFW-23099/206/2023/M/2033 dated August 4, 2025 as follows:- "In view of representations received and after careful considerations, it has been decided that due to inadvertent mistake, the candidates who had registered themselves as NRI candidates during the process of online registration have to mail a request letter (in a signed pdf format only in wbnricounselling2025@gmail.
com) addressing The Director of Medical Education, Swasthya Bhaban, with a request to allow for initialization of the registration details submitted earlier, so that the candidate can freshly re-submit the candidate details, payment of fresh counseling fees and to download the candidate profile letter for allotment of verification centre, which is applicable from the next round only. Needless to mention that this facility is not available in the Stray Vacancy round or any round later (if any) of counseling.
Such request mail is accepted only on the dates of admission process of that particular round of counseling, in which such inadvertent mistake was done by the candidate himself/herself.
All concerned are hereby informed accordingly."
The first round of counseling is scheduled to be held on August 12, 2025.
Mr. Sounak Bhattacharya, learned advocate for the petitioner submits that the petitioner would not be able to participate in the said first round of counseling if the procedures prescribed in the abovementioned communication are required to be followed, he prays that the petitioner may be allowed to make necessary correction in his application already filed for registration/verification so that he can participate in the first round of counseling.
Mr. Jayanta Samanta, learned advocate for the State, on instruction, submits that the Government, as a matter of policy, has taken a stand that the candidates who have made mistakes in their online application would be given opportunity to participate in the second round of counseling subject to fulfillment of the procedures prescribed in the aforesaid Memo, besides, the preparation for first round of counseling is complete therefore, at this stage, the petitioner cannot be allowed to participate in the said round of counseling.
In the backdrop of the aforesaid facts and circumstances, this Court is not inclined to entertain the prayer of the petitioner, however, he is at liberty to participate in the second round of counseling, upon prior compliance with the procedure prescribed in the abovementioned communication dated August 4, 2025. WPA 18245 of 2025 is thus disposed of without any order as to costs.
