Petitioner is aggrieved by the fact that in spite of representation being made to the Inspector-inCharge, Jagatballavpur Police Station as well as the Superintendent of Police, Howrah Rural Police District, no steps have been taken.

Such representation was made on 09.07.2024. Petitioner expresses agony that the shop room is in a miserable condition and as such, any time it can collapse.

Learned advocate appearing for the private respondent nos. 5 and 6 submits that the respondents have title over the property and the common passage is being blocked by the petitioner. As none appears on behalf of the State, Mr. Ranjit Rajak, learned advocate, who ordinarily appears for the State, is directed to represent the State. His appointment may be regularised by the concerned authorities.

In view of the nature of the dispute existing, I am of the view that the police authorities have

hardly any role to involve themselves. Police authorities obviously would interfere in case they find that there is breach of any law and order. Rest of the issues are concerned, parties would address the same before the civil court.

With the aforesaid observations, the writ petition being WPA 19249 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.

There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
