The petitioners are aggrieved by rejection of their technical bid against the NIT for Road Transportation of bulk petroleum products by bottom loading tank trucks, Ex-Jharsuguda Terminal.

It is submitted that although certain discrepancies were noted by the IOC for non-supply of certain documents as stipulated in the NIT, they should have been given a further opportunity in terms of the NIT itself, to clarify and upload such documents.

It appears from the records and submissions of the IOC that the petitioners were informed on 7th September, 2021 as regards deficiency in the bid, particularly in the context of supply of the amended partnership deed and Form A.

The evaluation was deferred to 14th September, 2021. Therefore, rejection of the bid on 14th September, 2021, after being given ample opportunity to submit the

documents, is sufficient compliance of the requirement of providing an opportunity to the petitioners to rectify the bid.

In that view of the matter, no relief can be granted to the writ petitioners in the instant writ petition. Accordingly, the writ petition is disposed of without any order.

There will be no order as to costs.
