Petitioner no.1 appears in person and submits that the petitioners have been implicated in connection with Rishra Police Station Case No. 99 of 2021 dated 18.07.2021 wherein charge-sheet has been submitted by the investigating agency. It has also been submitted that the next date has been fixed on 13.02.2023. The petitioners intend to agitate the points canvassed in the present revisional application and/or other issues relating to discharge before the learned Magistrate who is in seisin of the instant case.

Accordingly, the petitioners are granted liberty to approach the learned Magistrate at the stage of consideration of charges. To that extent, the petitioners would be at liberty to exhaust the relevant provisions of law thereby praying for discharge.

Learned Magistrate would consider the merits of the case and dispose of the application so filed at the instance of the petitioners in accordance with law.

With the aforesaid observations, the revisional application being CRR 2451 of 2021 is disposed of. Interim order, if any, is hereby vacated.

All pending connected applications, if any, are consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
