....Advocate This application under Article 227 of the Constitution of India is at the instance of the defendant no.1 praying for a direction upon the learned Civil Judge (Senior Division), Diamond Harbour to dispose of an application praying for allowing the petitioner to make construction which was filed on December 15, 2018 in T.S. 195 of 2009 expeditiously.

The learned advocate appearing for the petitioner submits that such application is otherwise ready for hearing.

In view of the order sought and proposed to be passed, this Court feels that there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate appearing for the petitioner shall be obliged to forward a copy of

this application along with this order upon the opposite parties or upon the learned advocate representing the opposite parties before the learned Trial Judge.

In the light of the submissions made by the learned advocate appearing for the petitioner, CO 2902 of 2025 is disposed of by requesting the learned Civil Judge (Senior Division), Diamond Harbour to take up the hearing of the application dated December 15, 2018 filed by the petitioner herein in Title Suit No.195 of 2009 to raise construction and to dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties. Urgent photostat certified copy of this order, if applied for, be supplied to the parties after completion of all necessary formalities.
