The petitioner is in custody for more than a year and prays for bail.
Learned counsel for the State opposes the prayer. I have considered the material on record.
The petitioner appears to be the principal assailant who shot the victim. The offending fire arm has been recovered at the instance of the petitioner. The bullet recovered from the place of occurrence has matched with the said fire arm. This Court is informed that the prosecution proposes to examine 15 witnesses and 3 witnesses are left to be examined.
Learned counsel for the State submits that witness action is expected to conclude by this month.
Considering the material on record and prima facie role of the petitioner in the alleged offence, prayer for bail is rejected at this stage.
The learned trial Court is directed to expedite the trial without granting any unnecessary adjournment to either of the parties.
The application for bail is disposed of.
