And In re: Saddam Hossain ... petitioner Mr. Kaushik Choudhuyry ...for the petitioner Mr. Ranadeb Sengupta Ms. Sreetama Das ...for the State Learned Counsel appearing on behalf of the petitioner submits that the petitioner is in custody for about 110 days since 17.05.2025 and nothing was recovered from his possession and his name transpired from the co-accused statement and the only allegation against the present petitioner is about call details record, which does not have any senses in the absence of transcription and considering his period of detention, he may be released on bail on any terms and conditions. He further submits that the co-accuse Pintu Pal is on Court bail and he is almost on the same footing with that of Pintu Pal.

Learned Counsel appearing on behalf of the State opposed the bail prayer contending that the investigation is still in progress. He further submits that the petitioner has three criminal antecedents in connection with the cases under NDPS Act and that he made 72 phone calls with the principal accused, Bellauddin. He further submits that the petitioner is not on the same footing with the coaccused Pintu Pal.

prima facie discloses involvement of the present petitioner with the alleged offence and that the petitioner has criminal antecedents and for which if he released on bail, there is likelihood of committing crime by the petitioner and as such rigour of Section 37 of the NDPS Act clearly attracts in respect of the present petitioner and as such his prayer for bail is rejected.

The application, being CRM (NDPS) 1003 of 2025 is accordingly disposed of.
