Mr. Sudip Sarkar Mr. Anindya Sundar Das Ms. Paramita Mondal Mr. Suman Halder Ms. Sneha Maity ..for the petitioner Learned counsel appearing for the petitioner submits that the order dated May 9, 2024, passed in WPA 12146 of 2023, directing the concerned Panchayat authority to take a decision regarding an alleged unauthorised construction, has not yet been complied with.

The present writ petition, in effect, seeks implementation of the said order dated May 9, 2024. Although a second writ petition is not per se barred when the relief sought pertains to execution or implementation of an earlier order, this does not imply that a writ court must invariably act as an executing forum for an order passed by another Bench of this Court in separate writ proceedings. The petitioner has an efficacious remedy before the learned Judge who passed the original order.

In view of the above, this writ petition is not entertained.

The petitioner shall, however, be at liberty to file an appropriate application in accordance with law. Accordingly, WPA 19183 of 2024 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
