The petitioner was the Head Teacher of Gayeshpur Gram Primary School under the District Primary School Council, Nadia (DPSC), District : Nadia. On attaining the age of superannuation, the petitioner had retired from her said service on December 31, 2008.

The ROPA 2009 came with effect from 1st April, 2008. The petitioner is alleging that she did not receive the arrear salary and revised pay scale for the period from April 2008 to December 2008 i.e. for the period of her active service.

A representation of the petitioner addressed to the District Inspector of Schools (Primary Education), Nadia, the respondent no.5 herein forms part of the writ petition. The said respondent is directed to consider the said representation of the

petitioner in accordance with law and to dispose if of within a period of six weeks from the date of communication of this order.

In the event, the petitioner is found to be eligible for such arrear salary, the same shall be released without any further delay and her basic pay would be revised so that she can get pension at a revised rate.

WPA 18469 of 2023 is disposed of with the above terms without any order as to costs.

Since no affidavit has been invited, the allegations contained in the writ petition are deemed to have been denied by the respondents. Urgent Photostat certified copies of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
