Petitioner has approached this Court being aggrieved by the inaction of the police authorities, particularly with regard to the information which was submitted to the Officer-in-Charge, Shakespeare Sarani Police Station on or about 23.07.2024. There are accusations against her husband that she has been physically assaulted. However, in spite of the same no steps were taken by the police authorities. Report has been submitted by the learned advocate appearing for the State which reflects that on 23.07.2024 a written complaint was submitted with Shakespeare Sarani Police Station relating to physical assault on 16.07.2024. An enquiry was commenced since the nature of the dispute related to a matrimonial feud. However, on 30.07.2024

according to the police authorities the lady personally appeared before the police station and categorically stated that she did not wish to initiate the criminal proceedings or have any FIR registered. Having considered that the police authorities till date did not take any steps, It would be open for the petitioner to approach the jurisdictional Magistrate under the relevant provisions of law. Learned Magistrate would under such circumstances assess and ascertain regarding the genuinity of the allegations and thereafter pass necessary directions as he deems fit and proper. With the aforesaid observations WPA 19270 of 2025 is disposed of.
