Imam Mr. Akash Ganguly ..for the State Learned counsel appearing on behalf of the petitioner submits that there is a delay of two days in lodging the FIR. Eleven, out of twelve accused, have been granted anticipatory bail by the Sessions Judge.

Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He submits that the present petitioner is the principal accused whose name has been taken by the victim. The injury report shows a cut injury inflicting on the head of the victim which required ten stitches for repair.

Considering the incriminating materials available in the case diary including the injury report and the statements of victim and other witnesses and the alleged role ascribed to the present petitioner, I do not consider this is to be a fit case for granting anticipatory bail.

Accordingly, the application for anticipatory bail of the petitioner is rejected.

The personal appearance of the Investigating Officer is noted and is dispensed with.
