Subsequent thereto, a restoration application was filed and the same was allowed by an order dated 21st January, 2026 recalling the order of dismissal for default dated 9th September, 2025. However, today, no one appears on behalf of the appellant and no accommodation has been sought for though Mr. Mitra, learned advocate appearing for the writ petitioner/respondent, is present.

It, thus, appears that the appellant is not interested to proceed with the present appeal.

In view thereof, the appeal being MAT 1270 of 2025 is dismissed.
