Order dictated by Arijit Banerjee, J.:

The petitioners say that they had no control over the place from where seizure of commercial quantity of phensedyl syrup was made. They are in custody for five months. Charge is yet to be framed.

Learned Advocate for the State says that today is the date fixed for consideration of charge. However, he does not have instructions as to what happened before the learned Trial Court today. There is sufficient incriminating material against these petitioners. All efforts will be made to expedite the trial. 3.

We have seen the material on record. Prima facie there appears to be involvement of the petitioners in the alleged crime. However, since the petitioners are in custody for some time, we direct the learned Trial Court to expedite the trial as much as possible and conclude the same at an early date and preferably within a year from the next date fixed for trial. Parties are directed to communicate this order to the learned Trial Court.

We are told that 30 witnesses have been named in the charge sheet. However, it is up to the Public Prosecutor to decide whether or not examination of 30 witnesses will be necessary. 5.

CRM (NDPS) 1213 of 2024 is, thus, dismissed.
