1. This application under Article 227 of the Constitution of India is at the instance of the husband praying for a direction upon the learned Addl. District Judge, 3rd Court, Barasat to dispose of the Matrimonial Suit No.197/2016 which has been re-numbered as Matrimonial No.1877/2016 as expeditiously as possible.

2. Mr. Sau, learned advocate appearing for the petitioner submits that the husband is regularly paying maintenance of Rs.27,000/- per month without any default. He further submits that August 28, 2025 has been fixed for cross-examination of PW-2. He further submits that the petitioner is an Assistant Teacher of a school in Assam and the petitioner has to travel from Assam to Kolkata on every dates fixed in the matrimonial suit. He further prays that a direction be passed upon the learned trial judge to fix consecutive

dates in the matrimonial suit considering the fact that the petitioner has to travel from Assam to Kolkata.

3. In view of the order sought for and proposed to be passed, there is no necessity to direct issuance of notice upon the opposite party. However, the learned advocate appearing for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite party.

In the light of the submissions made by Sau, learned advocate for the petitioner, CO 2912 of 2025 is disposed of by requesting the learned trial judge to make an endeavour to dispose of the Matrimonial Suit No.1877 of 2016 as expeditious as possible without granting any unnecessary adjournments to either of the parties provided the husband is not in default in payment of maintenance or alimony.

It will be open for the petitioner to make a prayer before the learned trial judge for fixing consecutive dates for hearing the matrimonial suit and if such a prayer is made, the learned trial judge is requested to consider the same sympathetically and in accordance with law, subject to the business of the learned trial judge.

6. With the above observations and directions, CO 2912 of 2025 is disposed of.
