Petitioners are directed to serve a copy of the revisional application upon Mr. Tanmoy Kumar Ghosh and Mrs. Manisha Sharma, learned advocates who ordinarily appears on behalf of the State. Their appointments may be regularized by the concerned Authorities in due course.

The grievance of the petitioners relates to the proceedings arising out of Chandannagar P. S. Case No. 72 of 2023 dated 20.04.2023.

Learned advocate appearing on behalf of the petitioners submits that the petitioners have been falsely implicated in this case and one of the petitioners being a government employee is facing departmental proceeding because of a civil dispute has been given the colour of a criminal proceeding and out of mala fide the petitioners have been implicated in connection with this case which is of an oblique motive of harassing the petitioners. I have considered the submission advanced on behalf of the

petitioners but I find that the investigation of the case is in progress at this stage. The obvious fact of the accused persons being implicated because of other disputes are subject matter of consideration of investigation.

In view of the aforesaid, I direct that the Investigating Agency will take steps so that in this type of cases, efforts are taken to conclude the investigation at the earliest.

The Deputy Commissioner in charge of Chandannagar PS will asses the factual circumstances as also the complicity of the present petitioners and thereafter give his opinion to the Investigating Officer before arriving at the conclusion while submission of the report under Section 173 of the Code of Criminal Procedure. With the aforesaid observations, the present criminal revisional application being CRR 2882 of 2023 is disposed of. Pending applications, if any, are consequently disposed of. .
