1. Affidavit of service filed on behalf of the petitioner is taken on record.

2. Supplementary affidavit filed on behalf of the petitioner is also taken on record.

3. Petitioner made an application for transfer on general ground (distance) on portal on 31st August, 2022 and same was forwarded by the school authority where petitioner is presently working to the concerned District Inspector of Schools (SE). District Inspector of Schools (SE) processed the transfer application and forwarded the same to the West Bengal Central School Service Commission through portal on 26th September, 2022. Grievance of the petitioner is transfer application of the petitioner is yet to be decided by the concerned authority of West Bengal Central School Service Commission.

4. Respondents are represented by learned advocates who have submitted perhaps contemporaneous decision could not be taken on transfer application of the petitioner due to suspension of portal with effect from 29th September, 2022.

5. Learned advocate for the Commission has submitted if concerned authority is directed transfer application can be decided in accordance with law.

6. Having considered the submissions made on behalf of the parties writ petition stands disposed of directing the Secretary, West Bengal Central School Service Commission to decide the transfer application of the petitioner by 6 (six) weeks from the date of communication of this order. Decision to be taken by the Secretary of the Commission shall be communicated to the petitioner by fortnight thereafter.

7. It is made clear that suspension of portal shall not be ground to reject transfer application of the petitioner.

8. Learned advocate for the petitioner is granted leave to amend the cause title in course of this day and add Secretary, West Bengal Central School Service Commission as additional respondent.

9. However service of notice upon additional respondent stands dispensed with since Commission is represented by learned advocate.

10. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings. (Saugata Bhattacharyya, J.)
