The statements recorded under Section 164 of the Code of Criminal Procedure of the eye witness, names the petitioner as one of the persons involved in the incident of murder. In view of the gravity of the offence and the involvement of the petitioner therein as transpiring from the materials in the case diary, we are unable to grant anticipatory bail to the petitioner.

Accordingly, prayer for anticipatory bail of the petitioner is rejected and the application being CRM (A) 4045 of 2022 is dismissed.
