Learned Advocate appearing for the petitioner submits that the petitioner was falsely implicated. The petitioner was initially implicated in a proceeding under Section 498A of the Indian Penal Code by the de facto complainant in the month of April, 2022. The petitioner obtained bail therein. Thereafter, the present police complaint was lodged with a delay of two days from the alleged incident. He draws the attention of the Court to the medical document of the petitioner. According to him, the petitioner suffers from 80% physical disability. Learned Advocate appearing for the State draws the attention to the materials in the case diary including the statement of the victim recorded under Section 164 of the Code of Criminal Procedure.

The statement of the victim recorded under Section 164 of the Code of Criminal Procedure implicates the petitioner. The petitioner underwent a medical examination test also. Considering the gravity of the offence and the involvement of the petitioner therein as transpiring from the materials in the

case diary, we are unable to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner is rejected. CRM (A) 4047 of 2022 is dismissed.
