1. None appears on behalf of the appellant.

2. Respondents are also not represented.

3. It appears from the earlier order passed by this Court dated 12th March, 2023 wherein learned Registrar Administration (L & OM) was directed to serve administrative notice upon the appellant to ensure his personal appearance before the Court.

4. In compliance of the said direction, a report is submitted by the Officer-in-Charge, Haridevpur P.S., Kolkata stating that the sole appellant Balaram Singha was expired on 2.5.2023 and a certificate of death of Balaram Singha is annexed.

5. As the sole appellant has already died so, the instant appeal stands abated against him.

6. So, the instant appeal be and the same is dismissed as abated.

7. Let a copy of this order along with the Trial Court Records be sent down to the Trial Court at once.
