Learned Advocate for the petitioner submits that there is fatal defect in the instant writ petition and his client intends to withdraw the same with liberty to file afresh on the self-same cause of action.

After perusing the averments made in the instant application we find that the petition involves defects, which are incurable.

Accordingly, the instant writ petition is dismissed as withdrawn with liberty to file afresh on the self-same cause of action.
