Despite service of notice private respondents are not represented.
Affidavit of service and a copy of notice of upgradation of the matter are taken on record. The petitioner claims to be prevented from entering into her property by the private respondent no. 7 & 8, Prasenjit Bera, her son and his wife, Bhagyashree Maity Bera.
Admittedly, the property was standing in the name of the petitioner's late husband.
Counsel for the State submits that three complaints have been lodged. One was lodged by the petitioner against the private respondents, her younger son and daughter-in-law and likewise two other complaints against the petitioner by the daughter-in-law and the son. All three cases have resulted in charge sheet.
In the above circumstances, the Officer-inCharge, Tamluk Police Station, Purba Medinipur shall escort the petitioner back into her residence and ensure that she is able to live there peacefully.
The private respondent no. 7 & 8 son Prasenjit Bera and his wife Bhagyashree Maity Bera shall not in any way harm the petitioner and shall take steps for her maintenance.
The aforesaid order is restricted to the petitioner only.
The petitioner shall visit the Tamluk Police Station on 30th September 2022 at 11 am.
Tamluk Police shall render assistance to the petitioner in the event of any threat or intimidation from her son Prasenjit Bera and his wife Bhagyashree Maity Bera.
With the aforesaid directions, the writ petition is disposed of.
There shall be no order as to costs.
The report of the Inspector-in-Charge, Tamluk Police Station, Purba Medinipur is taken on record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
