In this revisional application the petitioners being complainant before the Learned Additional Chief Judicial Magistrate, Alipore, South 24 Parganas has prayed before this Court so that the trial of the case A.C. Case No.4115 of 2017 can be conducted on a day to day basis and the same be concluded within three months.

Today, when the matter has been called none appears on behalf of the petitioners. The earlier order dated 22.02.2019 relates that a prayer was advanced for filing Supplementary Affidavit. However, the records do not reflect that within the period of four weeks so allowed by the Learned Court, there has been any compliance.

The subject matter of the case relates to defamation proceedings and I find that the learned Magistrate was pleased to issue process against the accused persons.

Having regard to the fact that the stage of evidence was yet to be commenced when the petitioners approached before this Court for expeditious trial, I am of the opinion that no blanket order can be passed for expediting progress of the trial. However, the revisional application was filed in the year of 2018 and more

than four years have passed, if in the meantime the trial has commenced, the Learned Trial Court is directed that suitable date be fixed for taking the trial to its logical conclusion within a reasonable period of time.

With the aforesaid observations, CRR 2650 of 2018 is disposed of.
