Shatarupa Dey .......Petitioner Mr. Bibaswan Bhattacharya ...for the Petitioner Since the petitioner seeks expeditious disposal of her application under Section 12/23 of the Protection of Women from Domestic Violence Act, 2005 (hereinafter referred to as the "Act of 2005") being AC Case No. 1333 of 2021 pending before the learned Judicial Magistrate, 9th Court, Alipore, South 24Parganas the matter may be disposed of without service of notice upon the opposite party. The opposite party shall not be prejudiced by an order directing expeditious disposal of the matter.

It appears that the case is pending before the learned Trial Court since 2021 and the application under Section 23 of the Act of 2005 has not been considered as yet.

In view of the above, the learned Trial Court is directed to consider and dispose of the application under Section 23 of the Act of 2005 filed by the petitioner within three (3) months from next date of hearing fixed before him. The learned Magistrate shall also endeavour to dispose of the application under Section 12 of the Act of 2005 as expeditiously as possible without granting any unnecessary adjournment to either party, in accordance with law.

CRR No. 3191 of 2024 is disposed of accordingly. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
