The present appeal has been preferred to challenge the legality of the order dated 9th July, 2024 passed by the learned Single Judge in WPA 16908 of 2023. By the said order, the writ petition filed by the writ petitioner/appellant was dismissed.

As we have invited the learned advocates appearing for the respective parties to advance their arguments on the merits of the matter, the delay in filing the present appeal is condoned, and the application under Section 5 of the Limitation Act, being IA No. CAN 1 of 2025, is disposed of.

The specific prayer made before the learned Single Judge by the writ petitioner/appellant was that she had successfully cleared TET 2014 and had also participated in the recruitment process of 2016. However, her name did not feature in the merit-based panel. Subsequently,

the respondents/authorities initiated a further recruitment process in 2020 pursuant to the notification dated 23rd December, 2020.

The writ petitioner/appellant filed the writ petition seeking a direction upon the concerned respondents to fill up the remaining 6,024 vacant seats/posts for appointment to the post of Assistant Teacher by reducing the cut-off marks.

The learned Single Judge, after considering the factual aspects of the matter, observed that there was no document to show that the petitioner had participated in the recruitment process of 2020. The panel for the recruitment process initiated in 2020 had expired on 15th February, 2022.

In view of the facts and circumstances of the case, we do not find any infirmity in the order impugned in the appeal, nor do we find any justification to interfere with the same.

In view thereof, the appeal and the connected applications are, thus, dismissed.

There shall, however, be no order as to costs. Urgent photostat certified copy of this order, if applied for, be supplied to the parties, upon compliance of all requisite formalities.
