The allegations made in the writ petition is a dispute between the apartment owners within a complex situated within the jurisdiction of Bardhaman Police Station.

There were representations of the petitioner before the police authorities and the police authorities have already ensured regarding the nature and character of the dispute which relate to rights of the parties in respect of the amenities and/or usage within the complex of the different members of the apartments. Prima facie it is reflected that on diverse opinion there are disputes between the parties and it is stated that the respondents allegedly have used unparliamentary

language and are in the habit of teasing. However the same prima facie do not make out any cognizable offence. If the situation so demands, petitioner would be at liberty to approach the Chief Judicial Magistrate, Purba Bardhaman or the appropriate Civil Court according to the dispute or difference which may surface.

Affidavit of service filed by the petitioner be kept with the record.

Report so submitted by the State be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. With the aforesaid observations WPA 19289 of 2024 is disposed of. Pending applications if any are disposed of.
